Top 3 contested issues to consider during a divorce

On Behalf of | Nov 15, 2022 | Family Law

Sometimes divorces are simple, but not always. Sometimes you can’t seem to agree on important issues. It helps to decide what you want and what you are willing to compromise on before going to court.

There are three very important issues that you need to consider if you want your divorce to go as smoothly as possible.

1. Child custody

Your children are undoubtedly very important to you. Consider the different types of custody and discuss them with your spouse. These include:

  • Sole custody: Only one parent makes decisions regarding a minor child.
  • Shared legal custody: Both parents make decisions regarding the minor child.
  • Sole physical custody: The child resides with one parent while the other has visitation.
  • Shared physical custody: The child resides part-time with one parent and part-time with the other.

Each type of custody has advantages and drawbacks.

Child support

Although courts generally determine the amount of child support, they may not allow job changes, extra expenses such as extracurricular activities, and advanced education. You must be aware of these expenses when determining a child support amount.

Division of property

Who gets what is always a question. Decide what you want and what you are willing to give up. Make sure that the things you want are clear from the onset of the divorce.

Your divorce may go more smoothly if you spend time thinking about what may be a problem and what you are willing to compromise on. Each side will have to bend a little before the divorce is complete.
